THE “MILK CALENDAR CUISINART” SWEEPSTAKES
Sweepstakes Rules
1. The “Milk Calendar Cuisinart” Sweepstakes is held by Dairy Farmers of Canada (the “Sweepstakes Organizers”). The Sweepstakes runs in Canada (except QC and Territories) and on Internet from 0:01 a.m. (ET) on January 1, 2012 to 11:59 p.m. (ET) on December 31, 2012 (the “Sweepstakes Period”).
ELIGIBILITY
2. The Sweepstakes is open to residents of Canada (except QC and Territories) who have reached the age of majority in the province where they reside. Employees, agents and representatives of the Sweepstakes Organizers, of any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, suppliers of prizes, material and services related to this Sweepstakes, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible.

3. Obtain a free Dairy Farmers of Canada 2012 Milk Calendar (the “Calendar”) which features a monthly recipe (“monthly recipe”). You can obtain a Calendar in one of the following ways during the Sweepstakes Period or until quantities last, whichever comes first:
3.1 Magazines: Calendars will be inserted in these magazines: Today’s Parent (January 2012), Chatelaine, English Edition (January 2012), Canadian Living (December 2011). In some areas magazines may have no calendar inserted;
3.2 Newspapers: Calendars will be inserted in one issue of approximately 1.9M newspapers in the provinces where the Sweepstakes is held;
3.3 By mail: ask for a Calendar by sending a self-addressed stamped envelope to: “2012 Milk Calendar Sweepstakes”, 1801 McGill College, Suite 700, Montreal, Quebec, Canada H3A 2N4. Allow two to three weeks following your mail-in request to receive your calendar by mail.
4. To enter, proceed as follows:
4.1 Go to MyMilkCalendar.ca/Cuisinart to access the Sweepstakes home page. Correctly answer the monthly question appearing on the home page, by using the monthly recipe on your Calendar. Click on «Enter Sweepstakes»;
4.2 On your first visit, click on «New Contestant» and on the next page enter your first name, last name, postal code and E-mail address. On your next visits, click on «Returning Contestant»;
4.3 Declare that you have read and agree with the Sweepstakes rules by checking the corresponding box;
4.4 Enter the text found in the image;
4.5 Click on «Sign in» and you will receive an email advising you to check your inbox or junk folder for a confirmation email, inside which you have to click on the link to complete your registration.
5. Limits. Entrants must respect the following limits otherwise they may be disqualified:
5.1 One entry per email per person per month during the Sweepstakes Period;
5.2 The use of only one e-mail address when an entrant has more than one.
PRIZES
6. Monthly prize. Each month during the Sweepstakes Period there is one prize to win. The 12 monthly prizes have an approximate value of $1,000 each and are described in Schedule A.
7. Grand Prize. There is one grand prize to win at the end of the Sweepstakes Period. The grand prize has an approximate value of $4,000. It consists of a Cuisinart package described in Schedule A and a chef at home to cook a five course meal for six people (the “Meal”).
8. The following condition apply to all prizes listed in Schedule A: the colour may differ from the illustration of the prizes appearing on the Sweepstakes advertisement and it will be at the Sweepstakes Organizers discretion.
9. The following conditions apply to the Meal:
9.1 The choice of Chef will be at the Sweepstakes Organizers sole discretion;
9.2 The choice of the five course Meal will be at the Chef’s sole discretion;
9.3 Are included the services of the Chef and one serving staff for a maximum duration of five (5) hours;
9.4 Are included the meal, wine, accessories (plates, cutlery, glasses, table napkin) and clean-up of the Meal area;
9.5 Choice and quantities of food, wine and accessories are at the Sweepstakes Organizers sole discretion;
9.6 The Meal must take place no later than March 31, 2013 or otherwise void. Once arrangements regarding the Meal have been made, no changes will be allowed. The Meal will be cancelled if the winner is not able, for whatever reason, to host the Meal in accordance with the arrangements made;
9.7 The winner must make arrangements related to the Meal directly with the Sweepstakes Organizers or their representatives in accordance with the timeframe and instructions received, subject to the Chef’s availability;
9.8 If the Sweepstakes Organizers believe, at their sole discretion, that it would be difficult or impossible to get to the winner’s house, the Meal will be awarded in cash ($2,000) without further compensation to the winner;
9.9 If the winner’s house is located in a remote area, the Sweepstakes Organizers may, at their sole discretion, decide to award the Meal in cash ($2,000) without further compensation to the winner;
9.10 To be declared a winner, the selected entrant must agree that the Chef may, if required, visit the house where the services are to be rendered. If the Chef believes that the services cannot be rendered in a professional manner, for whatever reason, the Meal may be awarded in cash ($2,000) without further compensation to the winner, and such at the sole discretion of the Sweepstakes Organizers;
9.11 Alcoholic beverages other than wine are not included;
9.12 If there are less than six people attending the Meal, the winner will not be entitled to any compensation;
9.13 The Chef may decide to not render the services if there are more than six people attending the Meal. In such case the Meal will be cancelled without further compensation to the winner or attending guests;
9.14 The Chef cannot serve wine to minors who could be attending the Meal;
9.15 At the time arrangements for the date and Meal details are made, the winner must inform the Sweepstakes Organizers of any food allergies. The Chef will take such allergies in consideration when deciding of the menu. In the case it is not possible, the problematic portion of the menu will be cancelled without further compensation;
9.16 The winner is responsible to be informed by the guests of any food allergies they may have and to disclose it, if applicable, to the Chef prior to the Meal. The winner will be responsible for any damages suffered by a guest resulting form an allergy;
9.17 If, within the execution of the services related to the Meal, events or acts of an illegal nature or any other situation that could compromise the execution of the services in a safely or professional way, or in any other way whatsoever occur, the Chef may decide at his sole discretion to not render the services and leave the premises. In such case, the prize will be void without compensation to the winner.
10. Prize limit. There is a limit of one monthly prize per person and per household during the Sweepstakes Period.
DRAW
11. Monthly prizes. At 12:00 a.m. on the first working day of each month, from February 2012 to January 2013, at the office of the agency in charge of the conduct of the Sweepstakes located in Montreal, a random draw of one (1) eligible entry will be held among all entries registered during the previous month to award the monthly prize.
12. Grand prize. On the first working day of January 2013, immediately after the draw to award the December 2012 monthly prize, a random draw of one (1) eligible entry will be held among all entries registered during the Sweepstakes Period to award the grand prize.
13. Odds of winning. The odds of an entrant’s entry being selected in a monthly draw depend on the number of eligible entries registered during the previous month. The odds of an entrant’s entry being selected in the grand prize draw depend on the number of entries registered during the Sweepstakes Period.
AWARDING OF PRIZES
14. To be declared a winner of a prize, a potential winner must:
14.1 Be reached by phone or by email, at the sole discretion of the Sweepstakes Organizers, within ten (10) days following the draw. If a potential winner is reached by email, he/she must reply in accordance with the instructions given in the email, as the case may be. Return of an email prize notification as undeliverable will result in disqualification and selection of an alternate entrant;
14.2 Correctly answer, without help, the mathematical skill-testing question on the Declaration and Release Form (the “Declaration Form”) that will be sent by email by the Sweepstakes Organizers;
14.3 Fill out and sign the Declaration Form and return a duly signed copy by email or fax to the Sweepstakes Organizers within ten (10) days of its receipt.
15. Failure to comply with any of the conditions mentioned in these Sweepstakes Rules or to accept a prize will disqualify the potential winner. In such a case, the Sweepstakes Organizers may, at their sole discretion, cancel the prize or hold a new draw until an entrant is selected and declared a winner.
16. Within four (4) to six (6) weeks following the receipt of the duly signed original Declaration Form, the Sweepstakes Organizers will deliver their prize to the winners and contact the grand prize winner to make arrangements for the Meal.
GENERAL CONDITIONS
17. Verification. Entries and Declaration Forms are subject to verification by the Sweepstakes Organizers. Any entry or Declaration Form which is, as the case may be, incomplete, illegible, manually or mechanically reproduced, mutilated, fraudulent, obtained from an unauthorized source, received or submitted late, bearing an invalid email address or phone number, does not allow to correctly identify the entrant or otherwise noncompliant shall be rejected and will not entitle the entrant to an entry or to a prize, as the case may be.
18. Sending of documents. The Sweepstakes Organizers are not responsible for Declaration Forms or mail-in request for a Calendar that were improperly sent, received late or lost.
19. Disqualification. The Sweepstakes Organizers reserve the right to disqualify a person or to cancel one or several entries of a person who participates or tries to participate in this Sweepstakes or claims a prize by using methods that do not comply with these Sweepstakes Rules or that are unfair to other entrants (e.g. entries exceeding the authorized limit). Such a person may be reported to the appropriate legal authorities.
20. Conduct of the Sweepstakes. Any attempt to deliberately damage the Sweepstakes web site and/or any related web site or to sabotage the legitimate conduct of this Sweepstakes constitutes a violation of civil and criminal laws. Should there be any such attempts, the Sweepstakes Organizers reserve the right to reject the entrant’s entries and obtain legal or equitable relief under applicable laws.
21. Acceptance of prize. Prizes must be accepted as described in the Sweepstakes Rules and may not, in any case, be in whole or in part transferred to another person, replaced by another prize or exchanged for cash, except as provided below.
22. Substitution of prize. In the event where it would be impossible, difficult and/or more costly for the Sweepstakes Organizers to award a prize (or a portion thereof) as described in these Sweepstakes Rules, they reserve the right to award a prize (or portion thereof) of the same kind and of equivalent value or, at their sole discretion, the cash value of a prize (or portion thereof) as indicated in the Sweepstakes Rules.
23. Liability limit: use of the prize. By entering the Sweepstakes, any entrant selected for a prize releases and holds harmless the Sweepstakes Organizers, any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, their employees, agents and representatives (the “Released Parties”) from and against any damage resulting from the claim, acceptance or use of the prize.
24. Liability limit: prize supplier. Any entrant selected for a prize acknowledges that upon receipt of the prize, the obligations related to it become the responsibility of the manufacturer of the prize.
25. Web site. The Sweepstakes Organizers do not warrant that access to or use of the Sweepstakes web site will be uninterrupted during the Sweepstakes Period or error-free.
26. Liability limit: conduct of the Sweepstakes. The Released Parties disclaim all liability for any of the following that may limit or prevent any entrant’s participation in the Sweepstakes, claiming of a prize or reading of the Sweepstakes Rules, as the case may be: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The above-mentioned persons also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page or software or by the transmission of any information related to the Sweepstakes.
27. Sweepstakes modification. The Sweepstakes Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Sweepstakes in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the Sweepstakes as provided in these Sweepstakes Rules.
28. Prize limit. In no event shall the Sweepstakes Organizers be required to award more prizes than indicated in these Sweepstakes Rules or to award a prize otherwise than in compliance with these Sweepstakes Rules.
29. Liability limit: participation in the Sweepstakes. Persons who enter or try to enter this Sweepstakes release the Released Parties from any liability for damage these said persons may incur as a result of their entry or their attempt to enter the Sweepstakes.
30. Handling of a Calendar. The Sweepstakes Organizers are not liable for improper use, handling or distribution of a Calendar or if, for any reason out of the control of the Sweepstakes Organizers, a Calendar is damaged. It is imperative for any person to be very cautious and take great care upon handling the Calendar.
31. Defective Calendar. Subject to the previous section, in the event of a manufacturer’s defect regarding a Calendar which implies that there is no monthly recipe on a Calendar or that the monthly recipe on a Calendar do not comply with the Sweepstakes Rules (e.g. does not allow a right answer to monthly question due to a printing error), the person in possession of a defective Calendar shall contact the Sweepstakes Organizers or their representatives in the same way than provided at section 3.3.
32. Authorization. By entering this Sweepstakes, any entrant selected for a prize authorizes the Sweepstakes Organizers and their representatives to use, if required, his/her name, photo, likeness, voice, place of residence and/or statement regarding a prize for publicity purposes, without any form of compensation.
33. Communication with entrants. No communication or correspondence related to this Sweepstakes shall be exchanged with entrants except as provided for in these Sweepstakes Rules or at the Sweepstakes Organizers’ initiative.
34. Personal information. Entrants’ personal information collected for the purposes of the Sweepstakes will only be used to administer the Sweepstakes. No commercial or other communications unrelated to the Sweepstakes will be sent to entrants unless they have otherwise agreed to receive such communications.
35. Property. Mail-in requests and Declaration Forms are the property of the Sweepstakes Organizers and shall not in any case be returned to entrants.
36. Entrant identification. For the purposes of these Sweepstakes Rules, the entrant is the person whose name appears on the Entry Form, and it is to this person to whom the prize will be awarded if he/she is selected and declared a winner.
37. Sweepstakes Organizers’ decision. Any decision by the Sweepstakes Organizers or their representatives regarding this Sweepstakes is final and without appeal.
38. Unenforceability. If a section of the Sweepstakes Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
